Fact Check: Did Trump Sign Into Law Felony for Which He's Indicted?

Donald Trump is expected to be charged on Tuesday over his handling and management of classified documents, news that the former president announced via social media this week.

While details of the indictment remain sealed, Trump told followers on his Truth Social site that he has been informed about the charges for what he's called the "boxes hoax." He will appear in court in Miami, Florida, on Tuesday as part of Special Counsel Jack Smith's investigation.

In what might be a particularly ironic outcome, one social media commentator claimed that if Trump is charged for mishandling classified documents, it would be under felony legislation that he signed while president.

The Claim

A tweet by @CalltoActivism, posted on June 9, 2023, viewed 2.6 million times, said: "MAJOR BREAKING: Donald Trump is facing five years in prison and a felony because of a law HE SIGNED in attempt to punish Hillary Clinton in 2018.

"Oh this is GOOD!

"The law HE SIGNED upgrades the crime of wrongly moving classified material from a misdemeanor to a felony.

"Trump signed the bill after spending the 2016 presidential campaign accusing Hillary Clinton of improperly handling classified information."

The Ruling

True.

In 2018, as part of legislation that extended the FISA Amendments Act, Trump signed changes to U.S. Code that upgraded the sentencing protocol for the crime of mishandling classified documents.

Previously punishable by no more than one year in jail, the change meant those found guilty could face up to five years behind bars, upgrading the crime from a misdemeanor to a felony.

While we don't know yet whether Trump has or will be charged under this law, the similarity of this legislation's wording to the offense that Special Counsel Jack Smith is said to have investigated strongly suggests it could be the case.

Surveying the reactions of top Republicans after Donald Trump’s indictment on charges of mishandling classified information, you’d think the country was in the midst of a coup.

“It is unconscionable for a President to indict the leading candidate opposing him,” House Majority Leader Kevin McCarthy tweeted. “The weaponization of federal law enforcement represents a mortal threat to a free society,” Florida Gov. Ron DeSantis claimed. “There is no limit to what these people will do to protect their power & destroy those who threaten it, even if it means ripping our country apart,” Sen. Marco Rubio declared.

These are extraordinary claims — and all made on Thursday night before the indictment or the evidence behind it was made public. On Friday morning, we learned thanks to CNN that Trump is literally on tape in 2021 discussing having documents in his possession that he knew were still classified. “As president, I could have declassified, but now I can’t,” he reportedly said.

The tape may or may not prove dispositive in a court of law; there’s certainly room for good-faith disagreement on the strength of the case against Trump. But the tape is at least very strong evidence that these charges are not some kind of Biden-mandated witch hunt but instead based on very serious allegations of wrongdoing.

Whilst it is nice to see Trump making regular appearances in court houses across the US I'm really surprised that more hasn't been done to try and hold Trump to account for the appalling way in which he dealt with Covid.

Her parents were Indian immigrants busting a gut, her real backstory is more interesting than pretending to be Grandma Walton making cookies.

I recall an impending nuclear apocalypse, street violence normalised for adolescent men and the beginning of long term joblessness.

There was a lot to celebrate too; the freedom available to younger kids being able to see a doctor same day if you were ill, and I'll always remember some inspirational schoolteachers.
